Preamble
The river cruise takes place as part of JAGD & HUND on a ship operated by Köln-Düsseldorfer Deutsche Rheinschiffahrt GmbH. The cruise includes a predefined route with gastronomic offerings and, if applicable, an entertainment program. The exact service components (e.g. travel time, departure/arrival point, program) can be found in the event description. We reserve the right to change the itinerary at short notice (e.g. due to the utilization of available berths).
1. Contractual bases
The travel contract is concluded exclusively on the basis of these terms and conditions and the booking confirmation.
Deviating conditions of the participant shall not become part of the contract, even if they are not expressly contradicted.
The booking participant is liable for all persons registered in the booking.
The booking is personal and non-transferable. It may only be exchanged or passed on with the consent of the organizer.
2. Services
Only the organizer’s booking confirmation is authoritative for the scope of services.
The organizer is entitled to make minor changes as long as these do not significantly affect the overall character of the trip.
3. Payment
The entire travel price is due within 7 days of receipt of the booking confirmation.
If payment is not made on time, the organizer may withdraw from the contract after issuing a reminder with a deadline and demand cancellation costs in accordance with Section 5.
The organizer reserves the right to pass on any additional costs incurred due to non-payment or incomplete payment (e.g. bank charges).
4. Insolvency protection
The organizer has the legally required insolvency insurance in accordance with § 651r BGB. The insurance certificate will be provided to the participant with the booking confirmation.
5. Withdrawal by the participant
The participant can withdraw from the contract at any time before the start of the trip.
The following cancellation fees apply (in % of the tour price):
– up to 90 days before departure: 30 %
– 89 to 60 days before departure: 50 %
– 59 to 30 days before departure: 80 %
– from 29 days before departure or in case of no-show: 100 %
The participant is at liberty to provide evidence of lesser damage.
6. Withdrawal and termination by the organizer
The organizer may cancel the tour before the start if the minimum number of participants is not reached or unavoidable exceptional circumstances (e.g. floods, storms, official orders, technical defects) significantly impair the tour.
In this case, the travel price already paid will be refunded. Further claims, in particular for self-organized arrival and departure or other third-party services, are expressly excluded.
The organizer may terminate the contract without reimbursement if the participant significantly disrupts the event despite a warning or violates safety regulations.
7. Obligations of the participant
The participant is obliged to notify the organizer or the on-board staff immediately of any defects that occur and to demand remedy. If the participant culpably fails to do so, claims for reduction or compensation are excluded.
The instructions of the ship and event personnel must be followed without restriction.
Animals are not permitted.
8. Liability
The liability of the organizer is – as far as legally permissible – limited as follows:
The organizer is liable without limitation for damages to life, body or health.
The organizer shall only be liable for other damages in the event of intent or gross negligence.
In the event of simple negligence, liability shall only exist in the event of a breach of essential contractual obligations (cardinal obligations) and shall be limited to the foreseeable damage typical of the contract.
Liability for items, valuables or cash brought along is excluded.
No liability is assumed for third-party services that are not part of the trip and are provided by third parties on their own responsibility (e.g. optional excursions).
9. Unused services
If the participant does not make use of individual travel services for reasons for which he/she is responsible, there is no entitlement to a pro rata refund.
10. Data protection
The personal data provided at the time of booking will only be used to process the contract. Details at: www.messe-dortmund.de/datenschutz.
11. Image and sound recordings
Image and sound recordings may be made during the trip. By participating, the participant agrees that these recordings may be used for the organizer’s public relations purposes, unless objected to in writing in advance.
12. Applicable law and place of jurisdiction
German law shall apply exclusively.
For legal action against the organizer, the registered office of the organizer is decisive, insofar as legally permissible.
